These Terms & Conditions (“Terms”) govern your use of the website located at macwellhealthpartners.com (the “Site”), operated by Macwell Health Partners LLC, also doing business as Macwell Locums (“Macwell,” “we,” “us,” or “our”). By accessing or using the Site, submitting information through it, or opting in to receive communications from us, you agree to these Terms. If you do not agree, please do not use the Site.
1. About Macwell
Macwell Health Partners LLC is a healthcare staffing firm providing locum tenens and permanent placement services to healthcare facilities, and connecting physicians, advanced practice providers, nurses, and allied health professionals with assignment and employment opportunities.
2. Use of the Site
You may use the Site for lawful purposes only, and in a manner consistent with these Terms. You agree not to:
- Use the Site in any way that violates applicable law or regulation;
- Submit false, misleading, or fraudulent information, including credentials or work history that is not your own;
- Attempt to gain unauthorized access to any portion of the Site, our systems, or any data not intended for you;
- Use automated means to scrape, harvest, or collect information from the Site, including job postings or contact information;
- Interfere with or disrupt the operation of the Site or the networks that support it;
- Use information obtained from the Site to solicit our clients, candidates, or employees for competing services.
3. Job Postings and Applications
Job opportunities described on the Site are offered subject to availability and may be modified or withdrawn at any time without notice. Postings are provided for informational purposes and do not constitute an offer of employment or engagement.
Submitting an application, résumé, or inquiry does not create an employment relationship, a contractual relationship, or any obligation on our part to present you to a client, place you in an assignment, or respond to your submission.
You are responsible for the accuracy and completeness of all information you provide, including licensure, certification, credentialing, and work history. Placement and assignment are contingent on credentialing, client approval, background screening, and applicable regulatory requirements.
4. Information You Submit
Information you submit through the Site is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By submitting information, you confirm that you are at least 18 years of age and that you have the right to provide the information you submit.
You grant Macwell permission to use the information you submit for the purpose of evaluating and pursuing staffing opportunities on your behalf, including sharing relevant professional information with healthcare facilities and credentialing organizations as described in our Privacy Policy.
5. Client Engagements
Services provided to healthcare facilities and other clients are governed by separate written agreements between Macwell and the client. Nothing on the Site modifies, supplements, or replaces the terms of any such agreement, and in the event of a conflict, the signed agreement controls.
6. Email Communications
By providing your email address, you consent to receive emails from us regarding opportunities, assignments, credentialing, scheduling, and related matters. You may unsubscribe from marketing emails at any time using the link in any such message. Transactional messages relating to an active assignment or application may continue.
7. Text Messaging (SMS) Terms
Program description. Macwell Health Partners LLC (operating as Macwell Locums) sends text messages to individuals who opt in, regarding job opportunities, assignments, credentialing, scheduling, and related communications.
How to opt in. You consent to receive text messages by submitting your mobile number through a form on our Site and checking the SMS consent box, or by otherwise providing express written consent. Consent is not a condition of employment, of receiving our services, or of making any purchase.
Message frequency. Message frequency varies.
Cost. Message and data rates may apply. Charges are billed by and payable to your mobile service provider.
How to opt out. Reply STOP at any time to stop receiving messages. You will receive a confirmation message, after which no further messages will be sent unless you opt in again.

Supported carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile service provider and is not guaranteed.
Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be sold or shared with any third parties. See our Privacy Policy for full details on how we handle your information.
Changes to your number. Please notify us if your mobile number changes so that messages are not sent to someone else.
8. Intellectual Property
The Site and its contents — including text, graphics, logos, images, and the Macwell and Macwell Locums names and marks — are owned by or licensed to Macwell Health Partners LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission, except that you may print or save individual job postings for your personal use.
9. Third-Party Links
The Site may link to third-party websites, including job boards, credentialing platforms, and social media. We do not control those sites and are not responsible for their content, security, or privacy practices. Links are provided for convenience only and do not imply endorsement.
10. Disclaimers
The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete, accurate, or current.
Nothing on the Site constitutes medical, clinical, legal, tax, or financial advice.
11. Limitation of Liability
To the fullest extent permitted by law, Macwell Health Partners LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or relating to your use of the Site, whether based in contract, tort, or any other legal theory, even if advised of the possibility of such damages.
12. Indemnification
You agree to indemnify and hold harmless Macwell Health Partners LLC and its officers, members, employees, and agents from any claims, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your use of the Site, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction of those courts.
15. Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
